Army Commander ordered to present second Court-Martial documents

The Colombo High Court has instructed the Army Commander to present copies of the entire court proceedings of the second Court Martial against Sarath Foseka. Colombo High Court Judge Sunil Rajapaksa issued this order today (February 14) when the Hi-Corp case against Fonseka was taken up.


The Supreme Court recently ruled that a Court Martial is a court accepted under the constitution of Sri Lanka, the attorney representing the former Army Chief had pointed out in court today.


He said that due to the Court Martial finding Sarath Fonseka guilty on charges related to the Hi-Corp fraud case, the High Court does not have powers to proceed with this case.


Therefore, the defendant Sarath Fonseka has to be released from the charges in question, Fonseka’s attorney addressed the court.


After considering the above mentioned points the High Court Judge instructed the Army Commander to present all documents of the second court-martial, to research in regard to this.


The judge also said that an appropriate order will be issued after it is considered and then postponed the trail to March 09.
