Supreme Court upholds SAITM ruling

The Supreme Court today upheld the Appeals Court decision calling upon the Sri Lanka Medical Council (SLMC) to register SAITM medical graduates.

The South Asian Institute of Technology and Medicine (SAITM) is legally eligible to issue medical degrees to its students, the Court of Appeal had ruled on January 31, 2017.

The Appellate Court had also directed the Sri Lanka Medical Council (SLMC) to give provisional registration to medical students passing out from the private medical college in Malabe.

However, the SLMC decided to appeal against the ruling of the Appeals Court to provisionally register SAITM medical degree holders.

The three-member bench chaired by Justice Eva Wansundera today rejected the appeal filed by the Sri Lanka Medical Council challenging the Appeal Court’s ruling.

Announcing the verdict, Justice Prasanna Jayawardena stated that the petitioner, a SAITM medical student, has a right to be registered with the Sri Lanka Medical Council as a medical practitioner in terms of Section 29(2) of the Medical Ordinance.

Accordingly the verdict delivered by the Court of Appeal on January 31, 2017 is lawful, the judge said.

He also ordered the SLMC to pay Rs 100,000 in compensation to the female student in question for the injustice she had faced due to the delay in her registration.
