A petition moving court to declare as null and void the Parliamentary seat held by Democratic National Alliance (DNA) leader Sarath Fonseka was rejected by the Appeal Court this morning.
When the three member bench took up the petition filed by Anandan Mohandas of Haputale, claiming that Sarath Fonseka had no right to be elected to Parliament as he was not a registered voter in Sri Lanka, Counsel representing the Elections Commissioner submitting preliminary objections told court that there were no reasonable legal provisions to continue with the petition.
Following this submission, Counsel for petitioner told courts that his client was willing to withdraw the petition.
Allowing the withdrawal and rejecting the petition, the Appeal Court told the petitioner that if the need arises, he could file a new petition on a future date.
