Five friends freed over death of Sri Lankan man

Five men heaved a sigh of relief when a Magistrate’s Court in Malaysia today freed them on a charge with causing the death of a Sri Lankan man who attempted to break into an apartment in Kota Kemuning in Shah Alam two years ago.

Magistrate P. Sarulatha ordered the five men, who are friends, to be released, after finding that the prosecution had failed to establish a prima facie case against them.

She ordered the release of Fairul Azwan Che Hassan, 29, Shahril Ridzuan Osman, 20, Muhammad Shafazrin Sa’arudin, 27, Ariffudin Abdul Aziz, 27, and Mohammad Aminudin Mohd Azizi, 21, without calling for their defence.

The five men were charged with causing the death of Abeysinghe Mudiyanselage, 24, at an apartment in Kota Kemuning here between 3am and 4am on Aug 9, 2015.

The charge against them were made under Section 149 of the Penal Code and if convicted, would be punished under Section 304 (b) of the same law, which provides an imprisonment for up to 10 years, or with fine, or both.

They were represented by lawyer Mohd Fadhly Yaacob, while deputy public prosecutor Nurul Huda Ramli prosecuted. — Bernama
