Nagananda Kodituwakku withdraws contempt of court petition

Attorney-at-Law Nagananda Kodituwakku has withdrawn the contempt of court petition filed against the social activist Oshala Herath.

The petition was taken up before the two-member appeals court judge bench consisting of Justices Sobhitha Rajakaruna and Dhammika Ganepola this morning (Dec. 05).

There, President’s Counsel Faisz Musthapha had appeared before the court on behalf of the defendant Oshala Herath, whereas the petitioning party raised objections over that, mentioning that there is no possibility of lawyers appearing on behalf of the respondent before issuing the notice of suit.

Nevertheless, the court which stated that a lawyer can appear for the respondent before the court, allowed the President’s Counsel to appear for the respondent Oshala Herath.

Later, the petitioner asked the court for permission to make amendments to the relevant petition, but the defendant raised objections regarding the request.

Subsequently, Nagananda Kodituwakku requested the court to allow the withdrawal of this petition, reserving the right to file a fresh petition.

The court which granted the request, decided to dismiss the petition by allowing it to be withdrawn.
