Petition filed over failure to hear challenge to 22nd Amendment Bill

A petition has been filed before the Supreme Court seeking a declaration that the fundamental rights of two petitioners were violated after the Court allegedly failed to hear a petition challenging the 22nd Amendment Bill to the Constitution presented to parliament by the government.

 

The fundamental rights petition was filed before the Supreme Court by Dulara Gunathilake, the Convenor of the Union of National Organizations and Shantha Jayathilake, a retired Sri Lanka Air Force officer.

 

The petitioners state that Dulara Gunathilake had previously filed a petition before the Supreme Court challenging the 22nd Amendment to the Constitution Bill presented to parliament by the government. However, they claim that the said petition was not called in open court for examination.

 

Accordingly, they have requested the Supreme Court to determine that their fundamental rights have been violated as a result of the omission.

 

They have also requested the Court to issue an interim order preventing its determination on the 22nd Amendment Bill from being communicated to the Speaker of Parliament until the present petition is heard and a final judgment is delivered.
